สิทธิของผู้ถูกกล่าวหาตามพระราชบัญญัติว่าด้วยการปรับเป็นพินัย พ.ศ. 2565

1. สิทธิในการขอผ่อนชำระตามมาตรา 9 วรรคสอง

ในกรณีที่ท่านไม่อาจชำระค่าปรับในคราวเดียวได้ มีสิทธิร้องขอต่อเจ้าหน้าที่ของรัฐหรือศาลเพื่อผ่อนชำระค่าปรับ โดยให้แจ้งเหตุผลในการขอผ่อนชำระและระบุจำนวนเงินที่ประสงค์จะผ่อนชำระมาในคำร้องขอผ่อนชำระ ณ ที่ทำการของหน่วยงานผู้ออกใบสั่ง

2. สิทธิในการยื่นคำร้องขอต่อศาลตามมาตรา 10 กรณีไม่มีเงินชำระค่าปรับเป็นพินัย

(1) ในกรณีที่เป็นบุคคลธรรมดาและกระทำความผิดทางพินัยเพราะเหตุแห่งความยากจนเหลือทนทานหรือเพราะความจำเป็นอย่างแสนสาหัสในการดำรงชีวิต อาจยื่นคำร้องเพื่อให้ศาลกำหนดค่าปรับเป็นพินัยต่ำกว่าที่กฎหมายบัญญัติไว้หรือขอทำงานบริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับเป็นพินัยได้ โดยให้แจ้งเหตุผลประกอบการยื่นคำร้องมาด้วย

(2) ในกรณีที่เป็นบุคคลธรรมดาและไม่มีเงินชำระค่าปรับเป็นพินัย อาจยื่นคำร้องต่อศาลโดยแสดงเหตุผลอันสมควรเพื่อขอทำงานบริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับเป็นพินัยได้

(3) การยื่นคำร้องตาม (1) หรือ (2) สามารถยื่น ณ ที่ทำการของหน่วยงานผู้ออกใบสั่ง

The Rights of the alleged offender under the Act on Imposition of Non-Criminal (Pinai) Regulatory Fines, B.E.2565 (2022)

1. The right to request payment by installments under section 9, paragraph two

In the case that you are unable to pay the fine in a lump sum, have the right to request government officer or a court for payment by installment, filing of a motion with reason, the amount of payment by installment at the office of the agency issuing the ticket.

2. The right to file a motion with a court under section 10, in the case where any person does not have money to pay Pinai regulatory fine

(1) In the case where any person is a natural person and committed a Pinai regulatory offence on account of unbearable poverty or because of a terrible necessity for living, such person may file a motion with a court request imposition of a fine that is lower than as provided by law or to perform community or public service work in lieu of Pinai regulatory fines, by notifying the reasons for submitting the request.

(2) In the case where any person is a natural person and does not have money to pay Pinai regulatory fine, may file a motion with valid reason, requesting to a court to perform community or public service work in lieu of Pinai regulatory fine.

(3) In the filing of a motion under (1) or (2) can be filed at the office of the agency issuing the ticket.

วิธีการชำระค่าปรับ

ผู้ได้รับใบสั่งอาจเลือกชำระค่าปรับด้วยวิธีการอย่างหนึ่งอย่างใด ดังต่อไปนี้

1. ชำระค่าปรับตามจำนวนที่ระบุไว้ในใบสั่ง ณ สถานีตำรวจหรือหน่วยงานที่ออกใบสั่ง หรือสถานีตำรวจทุกท้องที่ทั่วราชอาณาจักร

2. ชำระค่าปรับตามจำนวนที่ระบุไว้ในใบสั่ง โดยการส่งธนาณัติหรือตั๋วแลกเงินของธนาคารโดยทางไปรษณีย์ลงทะเบียน สั่งจ่ายให้แก่ผู้บัญชาการตำรวจแห่งชาติ พร้อมด้วยสำเนาใบสั่งส่งไปยังสถานที่และภายในระยะเวลาที่กำหนดไว้ในใบสั่ง ทั้งนี้ สำหรับการชำระค่าปรับทางไปรษณีย์จะมีผลสมบูรณ์ต่อเมื่อได้มีการเรียกเก็บเงินแล้ว และหน่วยงานที่ได้รับค่าปรับจะส่งใบเสร็จรับเงินให้ผู้รับทางไปรษณีย์

3. ชำระค่าปรับตามจำนวนและภายในเวลาที่กำหนดไว้ในใบสั่ง โดยวิธีการธุรกรรมทางอิเล็กทรอนิกส์ บัตรเครดิต หรือวิธีการอื่น โดยผ่านธนาคาร หรือ หน่วยบริการชำระเงิน อาทิ ATM, INTERNET BANKING หรือหน่วยบริการรับชำระเงินที่มีเครื่องหมาย PTM ทั้งนี้ สามารถชำระค่าปรับได้ภายหลัง 2 วันทำการนับจากวันที่ได้รับใบสั่ง โดยเอกสารหรือรายงานอิเล็กทรอนิกส์ ที่ธนาคารหรือหน่วยบริการรับชำระเงินออกให้ ถือว่าเป็นหลักฐานในการรับเงินค่าปรับ

How to pay the fine

The person receiving the ticket may choose to pay the fine by one of the following methods:

1. Pay a fine in the amount specified on the ticket at the police station or the agency issuing the ticket, or every local police station throughout the kingdom.

2. Pay a fine in the amount specified on the ticket by sending money order or bank bill of exchange payable, enclose with a copy of the ticket via registered mail addressing the Commissioner-General of Royal Thai Police, to the location specified on the ticket with in the due date. Hence, the payment status will remain pending until the transaction has been processed by a bank and the receipt has been issued and sent to the receiver by mail.

3. Pay a fine in the amount and within given period of time specified on the ticket by electronic transaction, credit card or other methods through a bank, or ATM, INTERNET BANKING or payment service provider where the “PTM” logo is displayed. Hence, the fine can be paid after 2 official days after receiving the ticket, document, or electronic report issued by the bank or payment service provider is considered as evidence of payment.

คำเตือนตามพระราชบัญญัติจราจรทางบก พ.ศ. 2522 และที่แก้ไขเพิ่มเติม

1. เมื่อเจ้าพนักงานจราจรได้ติด ผูก หรือแสดงใบสั่งไว้ที่รถหรือส่งใบสั่งทางไปรษณีย์แล้ว เมื่อพ้นกำหนด 15 วันนับแต่วันดังกล่าวให้ถือว่าเจ้าของรถหรือผู้ครอบครองรถได้รับใบสั่ง และให้สันนิษฐานว่าเจ้าของรถหรือผู้ครอบครองรถนั้นเป็นผู้กระทำผิดตามที่ระบุในใบสั่ง เว้นแต่เจ้าของรถหรือผู้ครอบครองรถจะได้แจ้งต่อพนักงานสอบสวนภายใน 30 วันนับแต่วันที่ได้รับใบสั่งว่าผู้อื่นเป็นผู้ขับขี่และผู้นั้นยอมรับว่าตนเป็นผู้ขับขี่ หรือในกรณีที่ไม่มีผู้ใดยอมรับว่าเป็นผู้ขับขี่ เจ้าของรถหรือผู้ครอบครองรถซึ่งไม่ใช่นิติบุคคลจะต้องแสดงหลักฐานให้พนักงานสอบสวนเชื่อได้ว่าตนเองมิได้เป็นผู้ขับขี่นั้น ตามมาตรา 140/1

2. กรณีเจ้าของรถหรือผู้ครอบครองรถได้รับใบสั่งตามมาตรา 140 วรรคหนึ่ง เป็นนิติบุคคล ให้ผู้แทนของนิติบุคคลนั้นมีหน้าที่แจ้งชื่อ ที่อยู่ พร้อมทั้งหลักฐานอื่นใด ต่อพนักงานสอบสวนที่แสดงว่าผู้ใดเป็นผู้ขับขี่ในขณะที่พบการกระทำความผิดตามที่ระบุไว้ในใบสั่งภายใน 30 วันนับแต่วันที่ได้รับใบสั่ง หากผู้แทนของนิติบุคคลไม่แจ้งภายในกำหนดระยะเวลาดังกล่าวให้นิติบุคคลนั้นต้องระวางโทษปรับในอัตราห้าเท่าของโทษปรับสูงสุดที่บัญญัติไว้สำหรับความผิดนั้น ตามมาตรา 160 จัตวา

3. เมื่อผู้ได้รับใบสั่งได้ชำระค่าปรับครบถ้วนถูกต้องแล้วคดีเป็นอันยุติ และผู้ขับขี่อาจถูกตัดคะแนนความประพฤติในการขับรถตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่ผู้บัญชาการตำรวจแห่งชาติและอธิบดีกรมการขนส่งทางบกร่วมกันกำหนด

Warning under the Road Traffic Act, B.E. 2522 and amendments

1. When the traffic officer has attached, tied, presented the ticket at a vehicle, or sent it by mail, it is considered that the owner or possessor of the vehicle hasreceived the ticket after 15 days since the above mentioned date, and they are considered as offender regarding charged specified on such ticket, unless they notify to inquiry officer within 30 days since receiving the ticket that another person drive, and such person admit it. If no one does, the owner or possessor of vehicle who are not juristic person shall present evidences to the inquiry officer to proof that they are not the driver according to section 140/1.

2. In the case that the owner or possessor of vehicle receiving the ticket according to section 140 paragraph one is a juristic person, the representative of juristic person has a responsibility to notify name, address, and any other evidences presenting that whoever is a driver of vehicle at the scene to inquiry officer within 30 days since receiving the ticket. If the representative of the juristic person does not notify within that period, such juristic person shall be fined five times of the maximum rate as prescribed for that offence according to section 160 quarter.

3. Once the person receiving the ticket pays a fine completely and correctly, the case will be dismissed, and the demerit points shall be deducted in according with regulation to the procedure, and condition determined by the Commissioner-General of Royal Thai Police and the Director-General of Department of Land Transport.
